Derivation of the Salique Law

A Dissertation on Dancing

The Midwife: or, The Old Woman's Magazine
Christopher Smart, 1753

THO' scarce three Days are elaps'd, since I employ'd as an Associate, the ingenious * Mons. Timbertoe, yet am I credibly inform'd that a vast Number of zealous Patriots and sincere Well-wishers to these Kingdoms are already much alarm'd and highly offended at this Procedure.
They urge that if a Person of my Consequence and Vogue, shou'd set an Example to encourage foreign Virtuosi in any Profession, Art or Calling, it will have an immediate and unavoidable Tendency, not only to discourage our own Artists, but to import and in a Manner naturalize all the Vassals of the Grand Monarch.
As I have the Honour to represent in this Oratory, all the Old Women of both Sexes in the Kingdom, I shall ever think myself responsible to my Constituents, I therefore beg leave by way of Apology, to insist on these two Articles.
First, the Excellency of Dancing in general. — And Secondly, the Pre-eminency of French Dancing in particular.
With regard to the former Head, we have no less Authority than that of the Wise Man and the Preacher, namely, that there is a Time to dance.
And the divine Socrates to far subscribed to this Opinion, that he did not think it too late to learn a Jig in his Old Age.
Not to omit the Romans, who had this Science, (for I can't call it by a less noble Name) in such Estimation, that they made it an Act of religious Worship.
But to depart from a general Review of this Scientific Piece of Activity, let us confine ourselves to our second Head, which was to shew the Superiority and Pre-eminence of French Dancing.
And here let not national Prejudice blind any Person so far, as to deny the French this Excellency, since it is the only one that they have out of the Million they pretend to.
For, as to the Mystery of Cookery, and the Craft of making Cloaths, I look upon them to be no more Excellencies than they are Cardinal Virtues.
Let not therefore I say an Anti-gallican Spirit, however laudible in some Cases, obtain too rigidly in this. — No — let us rather exert the true British Generosity, attributing to them a single Perfection, which by the Way is one more than with all their Politeness they wou'd ever bestow on us.
There is one Objection indeed to French Dancing, which I must not pass by because it nearly concerns my Sex, of which I shall always profess myself the Advocate and Guardian, — and that is the Salique Law, by which all Females are excluded from the Inheritance of the throne. — At first Sight the Critics will be confoundedly puzzled to find out a Connection between this Law and Dancing, but I Will soon set them right. — Postellus, Montanus, Menage, Du Hallan, and other ingenious Writers, have fumbled for a Derivation of the Salique Law, and have done no good at it.
This Word then is manifestly taken from Salii, which is in Latin the Dancers, and Lex Salica, or Lex Saliorum, is in English the Dancing Law, or the Law of the dancing Masters.
I have all due Respect for the Memory of the illustrious Pharamond, but can never forgive him the Promulgation of this Law, which is unjust and absurd to the last Degree; for the History of our own Nation will teach us, that Women are as capable as Men to administer Justice and make a People happy and glorious.
The Reigns of Elizabeth and Anne are Demonstrations of this Assertion. — Tho' a late Wit has given these Events a very malicious Turn.
The Women, says he, when they are on the Throne, behave best, because they are govern'd by Men. — And the Men have formerly cut a contemptible Figure in the fame Station, because they were govern'd by Women.
But to return to my Subject — The French Dancers must be still allow'd their Supremacy of Merit — which has not only been made clear from what I've said, but will farther appear from this Night's Performance of the inimitable Mr. Timbertoe.
To conclude — as when I see a Man of a sour, ill-natured, saturnine Disposition, I judge with Shakespear, that he has not Musick in his Soul. — So on the other Hand, when I see a clumsy, awkward, rustic, unmannerly Lout, I am confident he has not learn'd to dance.
